These Terms and Conditions constitute a legally binding agreement between LLC Fitness Solutions (hereinafter “FitShop” or “we”) and any person using the website fitshop.ge (hereinafter the “Customer” or “you”).
By registering on the Website, placing an order or using the Website in any way, you confirm your full and unconditional acceptance of these Terms and Conditions and of the Privacy Policy, which forms an integral part of this document. If you do not agree with these terms, please do not use the Website.
The Website is FitShop’s online store, through which Customers can purchase Products with delivery throughout Georgia.
FitShop is itself the seller of the Products listed on the Website — it sells its own stock and is responsible for the accuracy of product descriptions, correct pricing, order processing and the organization of delivery.
FitShop makes every effort to ensure that the information on the Website (description, composition, photos, price, stock) is accurate and up to date. Product photos may differ slightly from the product’s actual appearance (for example, due to updated packaging design) — this is not considered a defect.
The manufacturer or supplier may change a product’s composition or nutritional value without notifying FitShop in advance. In that case, the description and photos on the Website, as well as the Georgian-language label applied by FitShop, may temporarily not reflect the change. The most accurate information on composition is therefore the original label printed by the manufacturer or supplier, and in case of any discrepancy the original label prevails. FitShop updates the product description as soon as it learns of a change.
FitShop advises the Customer to always read the original label before using a product, especially if they have allergies, intolerances or dietary restrictions. If the composition of the product received differs materially from what was stated on the Website at the time of the order, the Customer may contact FitShop, and the matter will be handled in accordance with the return terms. This clause does not limit the Customer’s statutory rights.
FitShop may at any time unilaterally change its product range, prices and promotions. Such changes do not apply to orders that have already been confirmed.
An account (profile) is required to place an order on the Website. When registering, the Customer must provide accurate and complete information and keep it up to date as necessary.
The Customer bears full responsibility for the accuracy of the information provided. FitShop is not liable for any consequences of incorrect information (for example, delayed delivery).
The Customer is responsible for keeping their account details (username, password) secure. If there is any suspicion that a third party has gained access to the account, the Customer must immediately change the password or contact FitShop.
The Customer is responsible for all actions carried out through their account.
For security reasons, if fraudulent or suspicious activity is detected, or in the event of a material breach of these terms, FitShop may temporarily restrict or close the Customer’s account and will notify the Customer by email.
Only registered Customers can place orders. To place an order, the Customer must follow the instructions on the Website and fill in the required fields.
Before final confirmation, the Customer can review the order details (products, quantity, address, price) and correct them if necessary.
After placing an order, the Customer receives confirmation of receipt of the order by email and/or text message (SMS). The Agreement is deemed concluded from the moment FitShop confirms the order.
FitShop may cancel an order (in whole or in part) if: (a) the product is no longer in stock; (b) a clearly incorrect price was shown on the Website due to a technical error; (c) there is reasonable suspicion of fraud. In the event of cancellation, the Customer will be notified immediately and the amount paid will be refunded in full within 14 calendar days.
Prices on the Website are stated in the national currency of Georgia, the lari (₾), and include value added tax (VAT). The delivery fee is not included in the price and is shown separately at checkout.
Payment is made online by bank card through the secure payment page of a bank or licensed payment provider.
FitShop does not store or process full bank card details — the payment is processed in the payment provider’s secure system in compliance with international security standards.
The amount is charged when the order is placed. If FitShop cancels the order, the full amount is refunded to the same card used for payment.
FitShop delivers Products throughout Georgia. Deliveries in both Tbilisi and the regions are carried out by partner courier companies via the Quickshipper.ge platform.
The delivery fee depends on the zone and the order total and is shown at checkout.
Estimated delivery times: Tbilisi — 1–2 working days; regions — 4–6 days. These times are indicative and do not constitute a firm commitment by FitShop — the actual delivery time depends on the courier company, the delivery address and other objective circumstances.
The Customer must provide an accurate address and contact phone number. If delivery fails because the Customer provided incorrect or incomplete details or could not be reached, the cost of redelivery is borne by the Customer.
On receipt, the Customer must check that the packaging is intact. If any external damage is found, the Customer must record it with the courier and notify FitShop immediately (within 2 working days at the latest).
Under the Law of Georgia on Consumer Rights Protection, the Customer has the right to withdraw from a distance contract without giving any reason within 14 calendar days of receiving the Products.
Products can be returned only if:
The cost of shipping returned Products is borne in full by the Customer. FitShop does not offer free collection of returned Products. The Customer returns Products by courier or in person to an address agreed with FitShop.
Return procedure: the Customer contacts FitShop in writing at info@fitshop.ge or calls the call center at +995 32 2 07 72 00, states the order number and the Products to be returned, and then receives return instructions.
Refunds are made to the bank card used for payment no later than 14 calendar days after the notice of withdrawal is received. FitShop may withhold the refund until it has received the Products back or until the Customer provides proof of having sent them.
The following cannot be returned:
If a delivered product is defective, expired or different from what was ordered, the Customer is entitled to request a replacement or a refund in accordance with the Law of Georgia on Consumer Rights Protection. In such cases, FitShop covers the return costs.
If a defect is found, the Customer should contact FitShop at info@fitshop.ge, preferably with photos attached. FitShop will review the request and respond within a reasonable time.
The Website may be used and orders placed by persons aged 18 or over. Minors may use the Website only with the consent and under the supervision of a parent or legal representative.
Some products (for example, products with high caffeine content) are recommended for adults only, as indicated on the product page.
Food supplements offered on the Website are not medicinal products and are not intended to diagnose, treat or prevent any disease. A food supplement cannot replace a varied and balanced diet.
Product information on the Website does not constitute medical advice. It is recommended to consult a doctor before using the Products, especially during pregnancy or breastfeeding, in the case of a chronic illness, or while taking medication.
FitShop is liable to the Customer within the limits established by the legislation of Georgia. FitShop is not liable for damage caused by using Products other than as intended or contrary to the instructions on the label, or for delays caused by force majeure.
The content of the Website — logo, design, text, photos and software — is the property of FitShop or the respective rights holder and is protected by the legislation of Georgia. Its use without FitShop’s prior written consent is prohibited.
Manufacturers’ trademarks shown on the Website belong to their respective owners.
FitShop may unilaterally amend these Terms and Conditions. The updated version is published on the Website with the date of the change and takes effect upon publication. Registered Customers will be notified of material changes by email or via the Website. Continued use of the Website after a change constitutes acceptance of the updated terms.
These Terms and Conditions are governed by and construed in accordance with the legislation of Georgia, including the Law of Georgia on Consumer Rights Protection and the Law of Georgia on Electronic Commerce.
This document is published in Georgian, English and Russian. If the language versions differ, the Georgian version prevails.
The parties will seek to resolve any dispute through negotiation. If no agreement is reached, the dispute will be heard by Tbilisi City Court. This does not limit the Customer’s right to apply to the competent administrative authority designated by law.
